SWEETGREEN MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, REGARDING ANY BETA VERSION, INCLUDING ANY REPRESENTATION THAT THE SERVICES THEREUNDER WILL BE UNINTERRUPTED OR ERROR-FREE. FOR THE AVOIDANCE OF DOUBT, ALL BETA VERSIONS OF THE PROGRAM ARE EXPECTED TO CONTAIN DEFECTS WHICH MAY BE MATERIAL AND ARE NOT EXPECTED TO OPERATE AT THE LEVEL OF PERFORMANCE OR COMPATIBILITY OF A FINAL, GENERALLY AVAILABLE PROGRAM. BETA VERSIONS MAY NOT OPERATE ACCURATELY AND MAY BE SUBSTANTIALLY MODIFIED PRIOR TO THEIR RELEASE FOR GENERAL PUBLIC AVAILABILITY OR WITHDRAWN AT ANY TIME. ACCORDINGLY, YOUR ACCESS TO AND USE OF ANY BETA VERSION OF THE PROGRAM IS ENTIRELY AT YOUR OWN RISK. ANY FUTURE RELEASE, UPDATE, OR OTHER ADDITION TO FUNCTIONALITY OF THE PROGRAM WILL BE SUBJECT TO THESE TERMS, WHICH MAY BE UPDATED FROM TIME TO TIME.

sweetgreen Rewards (“Program”) is offered by sweetgreen, Inc. (“sweetgreen,” “we,” “us,” or “our”) to eligible individuals who enroll in the Program (“Members,” “you,” or “your”). Please read the Program Terms and Conditions (“Terms”) carefully. The Terms may have changed since you last read them. By (A) registering for an account with sweetgreen using the sweetgreen mobile application (“App”) or online at order.sweetgreen.com (“Website”), (B) redeeming Points (as defined below) or otherwise participating in the Program, or (C) if you have a registered sweetgreen account prior to your receipt of an email notice of your enrollment in the Program and declined to opt out of the Program after receiving such email notice of your enrollment in the Program, you agree to the Terms, as well as sweetgreen’s Terms of Use (“Terms of Use Terms”), which are incorporated by reference into these Terms (and vice versa) (including, without limitation the “Governing Law” and “Dispute Resolution” sections of the Terms of Use Terms). If you do not agree to be bound by these Terms in accordance with this paragraph, including any changes or modifications of the Terms, you may not participate in the Program. If you wish to opt-out of the Program or request the deletion of your account, you can email us at hello@sweetgreen.com. If you request the deletion of your account, you will lose access to all available Points effective as of the time we process your request and your account information will be deleted. SECTION 16 OF THE TERMS OF USE TERMS IS AN ARBITRATION CLAUSE THAT REQUIRES MOST DISPUTES BETWEEN US TO BE RESOLVED ON AN INDIVIDUAL, NON-CLASS ACTION BASIS THROUGH BINDING AND FINAL ARBITRATION INSTEAD OF IN COURT. SEE SECTION 16 OF THE TERMS OF USE AGREEMENT FOR MORE INFORMATION REGARDING THIS ARBITRATION CLAUSE, AND HOW TO OPT OUT. NOTWITHSTANDING ANY PROVISION IN THIS AGREEMENT TO THE CONTRARY, WE AGREE THAT IF SWEETGREEN MAKES ANY FUTURE MATERIAL CHANGE TO THE ARBITRATION CLAUSE, YOU MAY REJECT THAT CHANGE WITHIN THIRTY (30) DAYS OF SUCH CHANGE IN ACCORDANCE WITH PROCEDURES SET FORTH IN SECTION 16 OF THE TERMS OF USE TERMS. The Terms of Use Terms are expressly incorporated into these Terms. To the extent there are conflicts between these Terms and the Terms of Use Terms, these Terms will control with respect to the Program.

Eligibility. Individual residents of the 50 United States and the District of Columbia who are 16 years of age or older may enroll to become Members. If you are between the ages of 16 and 18 (or the age of majority in your jurisdiction of residence, if higher than 18), you may access and participate in the Program only with the consent and under the supervision of your parent or legal guardian. For the avoidance of doubt, only natural persons transacting in their personal capacity and for their own account (which may be by using a work or personal email) are eligible to participate in the Program. Third party aggregators, groups, organizations, and business entities are not eligible. sweetgreen reserves the right to delay enrollment until your membership eligibility is confirmed.

Account Creation. To become a Member and earn Points, you must create an account on the Website or the App. sweetgreen does not warrant that the App will be compatible with your mobile device. To download and use the App you must have a compatible mobile device (iOS or Android).

Your account is non-transferable and you may only have one (1) account at a time. If we discover that you have multiple accounts or otherwise violate these Terms, we reserve the right to terminate all such accounts in accordance with these Terms and invalidate any Points associated with such accounts.

Earning Points. Members will earn ten (10) points (“Points”) for each $1 they spend on eligible purchases made using the App, Website, or in-stores. In addition, we may offer additional opportunities to earn Points, including, but not limited to, milestones, promotions, and challenges which can be completed by purchasing certain menu items or reaching a specific spend level, order frequency or other thresholds as described in the specific terms and conditions for that opportunity.

To earn Points for in-store purchases, you must access your Earn and Redeem QR code via the App and scan it using the in-store terminal at checkout prior to completing payment for your order.

Cancelled orders will not earn Points. Points cannot be earned by ordering through any third-party platforms (including third-party delivery marketplaces such as DoorDash, GrubHub, Uber Eats or Postmates), or by placing catering orders. Transactions in which Points are redeemed and payments for taxes, tips, merchandise, gift cards, or any other fees, including bag fees, service fees and delivery fees will not earn Points, unless otherwise specified by us.

Points will deposited in your account within 24 hours of the date of your qualifying transaction. Points are automatically tracked and allocated to each Member’s account by sweetgreen or our service providers and our decisions and records regarding such calculations and benefits will be final and binding in all respects. Your eligibility to receive Points is subject to verification at all times.

Points cannot be transferred, exchanged, bartered, auctioned, sold, or redeemed for cash and have no value outside of the Program; any such Points will be void. The accumulation of Points does not entitle the Member to any vested rights, and sweetgreen does not guarantee in any way the continued availability of any reward.

Point Expiration. Points expire 180 days after the date they are deposited in your account. You forfeit all Points that you do not redeem prior to their expiration.

Point Redemption. To redeem your Points, follow the directions provided in the App or Website. Each reward item has its own specific Point value as set forth in the App and on the Website. Points cannot be redeemed for gift cards, cash, or gift certificates, unless otherwise stated by sweetgreen. Points will not be applied to any transaction automatically; you must follow the directions to affirmatively select and redeem Points for a specific reward. Points can only be redeemed for one (1) reward item in any single transaction. Points cannot be redeemed or stacked with an existing offer. Points are redeemed on a first-in first-out basis. sweetgreen reserves the right to restrict the use of Points in combination with other discounts and promotions. Points can only be redeemed in connection with qualifying pickup, sweetgreen native delivery and Outpost orders placed using the App or Website or in-store purchases using Scan to Redeem via the App. Points cannot be redeemed for in-store purchases made without using Scan to Redeem. Points cannot be redeemed in connection with orders placed through any third-party platforms (including third-party delivery marketplaces, such as DoorDash, GrubHub, Uber Eats or Postmates), or with catering orders. Points must be redeemed by the Member associated with the email address connected to the account that earned the Points. The Point redemption value cannot exceed the total purchase price of the order in which the Points are redeemed.

Member and Program Termination/Modification. sweetgreen reserves the right, in our sole and absolute discretion, to (i) suspend or terminate a Member’s account at any time for any reason or (ii) invalidate any Points we deem to have been awarded in error, or as the result of the use of an account to make orders by or on behalf of a third party aggregator, group, organization, or business entity or any actual or suspected fraudulent or dishonest activity (including without limitation, the use of any system, macro, script, or bot to manipulate the Program). Reasons for account suspension or termination or Point invalidation may include, without limitation, disorderly personal conduct at a sweetgreen location which actually or potentially harms sweetgreen, its parents, subsidiaries, affiliates, officers, employees, contractors, agents, business partners, and licensors or any third party, violations of law, or any other activity not in keeping with the letter and/or spirit of these Terms, as interpreted by us in our sole and absolute discretion. If your account has been suspended or terminated, you forfeit any accumulated Points and are prohibited from registering for a new account without the prior written permission of sweetgreen. sweetgreen is not liable for Points sent to suspended or terminated accounts.

sweetgreen may terminate the Program at any time, with or without notice, which may result in the cancellation of all Points, privileges and benefits associated with the Program. Except as otherwise expressly set forth in this Terms, sweetgreen reserves the right to modify any of the rules, terms, conditions, and benefits of the Program at its sole discretion, with or without notice. Interpretation of these Terms shall be at the sole discretion of sweetgreen, whose decision will be final. You agree that we not be liable to you or to any third party for any modification, suspension, or discontinuation of the Program or any part thereof. Your continued use of the Program indicates your acceptance of any revised terms.

Change to Your Account Information. You must advise sweetgreen of any change in your name or the address, phone number and/or email address associated with your account. Name, address, email and phone number changes can be made via the App sweetgreen or on the sweetgreen website. sweetgreen is not liable for e-mail communications, points or other perks sent to outdated contact information.

Release of Liability/General Conditions. By participating in the Program, you agree (i) to release, discharge, indemnify and hold harmless sweetgreen, its parent, subsidiaries, affiliates, and advertising and promotion agencies, and all of their respective officers, directors, shareholders, employees and agents (collectively, “Released Parties”) from any liability or damages which may arise out of participation in the Program. Released Parties are not responsible for late, lost, incomplete, delayed, inaccurate, garbled, undelivered, misdirected transactions, Points, emails, or other communications of any kind; or for or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, platform, application, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or problems of any kind relating to or in connection with the Program, whether printing, typographical, technical, computer, network. human, mechanical, electronic or otherwise, including, without limitation, errors or problems which may occur in connection with the administration of the Program, the tracking of transactions or tabulation of Points, the functionality of the App or Website, or in any Program-related materials.

TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, SWEETGREEN DISCLAIMS ANY IMPLIED OR STATUTORY WARRANTY, INCLUDING ANY IMPLIED WARRANTY OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE IN RESPECT OF THE PROGRAM. IN NO EVENT SHALL SWEETGREEN BE LIABLE FOR ANY DAMAGE WHATSOEVER ARISING OUT OF THE USE OF OR INABILITY TO USE OF ANY POINTS OR THE PROGRAM, EVEN IF SWEETGREEN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU ARE ADVISED TO SAFEGUARD IMPORTANT DATA, TO USE CAUTION AND NOT TO RELY IN ANY WAY ON THE CORRECT FUNCTIONING OR PERFORMANCE OF THE PROGRAM.

Released Parties are not responsible for injury or damage to Member’s or to any other person's device related to or resulting from participating in this Program or from or use of the App or Website.

All applicable federal, state and local laws and regulations apply. If any provision of these Terms is, for any reason, held to be invalid or unenforceable, the other provisions of these Terms will remain enforceable and the invalid or unenforceable provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law. Any waiver or failure to enforce any provision of these Terms on one occasion will not be deemed a waiver of any other provision or of such provision on any other occasion. These Terms are the final, complete and exclusive agreement between you and sweetgreen with respect the Program.

Personal Information. Your personal information collected in connection with this Program will be used in accordance with sweetgreen’s Privacy Policy, available here.
